'Phatak's fate in PMO's hands'

MUMBAI: After the Centre granted permission to the CBI to prosecute former municipal commissioner Jairaj Phatak in the Adarsh scam, it has emerged that the Prime Minister's Office (PMO) may decide whether the IAS officer will be sent on leave or suspended. Phatak is currently on central deputation and his appointment as chairman and managing director of the Rural Electrification Corporation was approved by the cabinet committee on appointments.

"In view of the major embarrassment caused to the Centre by the appointment of the former central vigilance commissioner P J Thomas, the PMO will now not take any risk," said a senior central government official. "A decision on Phatak, whether he should be sent on leave or be suspended, will be taken after receiving a report from the CBI. The CBI report will be placed before the department of personnel and training, which comes under the PMO, for a final decision," said a senior central government official.

Tuesday's CBI raids on Phatak's residences sent shockwaves through high-ranking bureaucrats, since he was regarded as one of the upright and honest babus. A month ago, along with the residences of a section of office bearers of the controversial Colaba society, the CBI had raided the residence of former urban development secretary Ramanand Tiwari.

When the CBI registered an FIR against 13 people, including former chief minister Ashok Chavan, Tiwari and former Mumbai collector Pradeep Vyas on January 29, the CBI informed the special court that since Phatak was an officer of the rank of joint secretary to the Government of India, his role would be investigated after obtaining approval from the Centre.

The CBI has accused Phatak of granting permission for the final height of the high rise, despite not having such powers. The state government had constituted a high-rise committee, which is chaired by a retired high court judge. All proposals for buildings having heights of more than 70 metres are to be referred to the committee. In the case of Adarsh, the height was increased to 100.7 metres without prior permission from the committee, the CBI said in its FIR. "Phatak, as a municipal commissioner, illegally regularized the same without referring to the high-rise committee," the CBI submitted in its FIR.

It is alleged that Phatak misused his position as municipal commissioner to secure a flat for his son Kanishka. Phatak has denied the allegation, saying his son applied for membership in the society in 2003 and the same was approved by the government on August 24, 2004. At the time he was school education secretary. He was municipal commissioner from May 2007 to October 2009. He has said he acted as per rules.

Among the 13 accused in the case, only two, Phatak and Vyas, are serving officers. Subhash Lalla, who was member of the state human rights commission, has quit, while Tiwari, who was information commissioner, was suspended after refusing to quit.

The record shows that the outcome of Parliament’s earlier JPCs has been quite disappointing on both, establishing what had happened and in identifying and punishing those culpable
Bofors (1987)
A joint Parliamentary committee was set up into the allegation that someone in the Congress had accepted bribes to buy the Bofors ‘shoot and scoot’ guns. Rajiv Gandhi was the Prime Minister and the Opposition alleged the trail went to him. The Opposition campaign was strengthened when finance minister V P Singh joined forces with them and quit the Congress. Finally after regular disruption of Parliament, when the government finally did accept the Opposition demand for a JPC, the Opposition parties boycotted the committee on the grounds that it was packed by the Congress. The JPC report was laid in parliament but was rejected by the Opposition.
Securities and banking deals (1992)
This JPC was set up in 1992 after allegations were made that ‘big bull’ Harshad Mehta had diverted funds from public sector Maruti Udyog Limited (MUL) to his own accounts, and had been unable to square accounts, provoking a record 570-point fall in the Sensex. It was only in October 1997 that the Special Court set up to hear the securities scandal-related cases could approve prosecution on 34 charges brought by the Central Bureau of Investigation (CBI). CBI in all filed 72 sets of charges relating to criminal offences, while 600-odd civil cases proceeded alongside. Of these, so far convictions have been secured only in the case of four. In September 1999, Mehta received a four-year sentence for defrauding MUL. But the recommendations of the JPC were neither accepted in full nor implemented.
Share market scam (2001)
Ahmedabad-based cooperative bank, Madhavpura Mercantile Cooperative Bank (MMCB), faced a run on its deposits because of heavy exposure to the stock markets. MMCB had a big exposure to the stock market through Ketan Parekh. The bank, in collusion with Ketan Parekh, issued pay orders without the backing of sufficient funds. Ketan Parekh, in turn, used this money to rig up the prices of shares. This nexus went unnoticed for almost a year but was broken when MCCB failed to honour the pay orders that it had issued. A JPC was ordered, which recommended sweeping changes in stock market regulations. However, many were diluted later.

हमसब जानते हैं की शर्मनाक स्तर का असंतुलित भ्रष्टाचार भ्रष्ट मंत्रियों और उसके पार्टनर उद्योगपतियों के गठजोड़ द्वारा देश व समाज को लूटने का साधन बन गया है तथा भारत सरकार इन सबकी दलाल और ऐसा इसलिए हुआ है की हमारे देश में भूख से बिलबिला कर चोरी करने वाले आम चोर और पोकेटमार को सजा देने का कानून तो है लेकिन उच्च संवेधानिक पदों पर बैठे हजारों करोड़ के चोर ,भ्रष्ट और गद्दारों की जाँच करने के लिए ना तो कोई स्वतंत्र जाँच एजेंसी है और ना की कोई सख्त कानून जिससे किसी भी भ्रष्ट मंत्री या उच्च अधिकारी को सरकार की अनुमति के बिना उनके कुकर्मों के लिए गिरफ्तार किया जा सके और आजीवन कारावास से लेकर फांसी की सजा तक दी जा सके |

आज भ्रष्ट मंत्रियों और उनके पार्टनर उद्योगपतियों के द्वारा इस देश के आम लोगों के हितों के साधन और संसाधन को इस तरह लूट लिया गया है की भ्रष्ट मंत्री और उद्योग पति 6000 करोड़ के घर में रहते हैं और हैवानों की तरह ऐय्यासी करते हैं तथा इस देश का आम बच्चा शिक्षा के लिए हर गांव में एक हाई स्कूल के लिए तरसता है तथा दो वक्त की रोटी व सर पर एक छत की जुगाड़ में जीवन मृत्यु का संघर्ष करता है...... 

बेहद शर्मनाक है की हमारे देश के भ्रष्ट मंत्री,सांसद,विधायक करोडपति हैं और हमारे देश की 40 प्रतिशत आबादी भर पेट भोजन के अभाव में सो जाती है.... बेहद दर्दनाक अवस्था है एक भारतीय नागरिक और उसके बच्चों के भविष्य की......

इन्ही सब कारणों से दुखी होकर श्री अन्ना हजारे (एक महान व इंसानियत को समर्पित  सामाजिक कार्यकर्त्ता) 5  अप्रेल 2011 से दिल्ली के जंतर-मंतर पर जनता द्वारा तैयार एक सख्त जन-लोकपाल बिल और एक सख्त, बेहद इमानदार ,पारदर्शी तथा जनता के सहयोग व सुझाव से  चयन किये गए जन-लोकपाल की नियुक्ति के लिए भूख हरताल पर बैठेंगे ....ये भूख हरताल 73 वर्ष की उम्र में इन्होने भारत के भविष्य को संवारने तथा इस देश के हर बच्चे के भविष्य को सुरक्षित करने के लिए ठाना है और इसमें भाग लेने के लिए अन्ना हजारे जी ने हर भारतीय का आह्वान भी किया है |

अतः हमसब का ये नैतिक दायित्व बनता है की हमसब 5 अप्रेल 2011 से रोज इनके समर्थन में जंतर-मंतर पर जाकर पूरा दिन और रात बितायें,जिससे इस बृद्ध सेनानी को हमारा समर्थन महसूस हो ....हम ऐसा करने के लिए अपने रिश्तेदारों तथा मित्रों को भी प्रोत्साहित करें.......हम बारी-बारी से कभी स्वयं,कभी बच्चों को कभी मित्रों को कभी,रिश्तेदारों को कभी अपने आस-पड़ोस के लोगों को जंतर-मंतर पर एक दिन व एक रात गुजारने के लिए नम्र निवेदन कर सकते हैं.....

मिस्त्र का तहरीर चौक बन सकता है दिल्ली का जंतर-मंतर अगर हमसब पूरे देश से एकदिन भी अन्ना हजारे जी के समर्थन में आ जायें...
